3.3 Due to objective factors such as screen color variations and lighting conditions during photography, slight visual color differences may occur; such variations are considered normal and do not constitute a product quality issue or a discrepancy with the product description.
3.4 While we strive to keep product inventory, style, and pricing information up to date, issues such as system latency, manual data entry errors, or delayed updates may occur. In the event of an error, we reserve the right to correct the information, adjust the order, or cancel the affected order prior to shipment and issue a full refund to the user.
3.5 All products are intended solely for personal, everyday wear; bulk reselling, secondary sales, and unauthorized commercial use are strictly prohibited.

4. Order Acceptance Rules
4.1 A user's submission of an order and completion of payment signifies only that the order request has been successfully submitted; it does not mean the order has become final or binding. We reserve the right of final acceptance regarding all orders.
4.2 We will review order details, the delivery address, payment status, and inventory availability. Stock preparation and shipment will only be arranged after the order passes this review.
4.3 We reserve the right to refuse or cancel an order and issue a full refund under the following circumstances: insufficient inventory, product discontinuation, abnormal pricing, invalid delivery address, incorrect order information, duplicate orders, malicious orders, payment anomalies, suspected fraudulent orders, or orders that violate platform rules.
4.4 Once an order passes review, the processes for stock preparation, shipment, and delivery will be carried out in strict accordance with the platform's Shipping Policy.

5. Pricing and Payment Rules
5.1 All prices listed on the platform are final selling prices in US Dollars; prices are clearly displayed with no hidden charges.

Regardless of whether a claim is based on contract, tort (including negligence), strict liability, or other legal grounds, we assume no legal liability for any losses arising from your use of the platform's services, your purchase of products through the platform, or any actions related to the platform's services or products—including but not limited to content errors, omissions, losses resulting from service usage, or losses arising from content posted or transmitted via the platform—even if we have been advised of the possibility of such losses.

10. Termination of Agreement
10.1 We reserve the right, at our sole discretion, to terminate this service agreement at any time without notice, or to suspend or terminate your access to all or part of the platform's services.
10.2 Upon termination of the agreement, you remain liable for all outstanding payments, liabilities for breach of contract, and related obligations incurred prior to the termination date. 10.3 Upon termination of the Agreement, the following provisions shall survive and remain in effect in perpetuity: Intellectual Property Rights, User Feedback, Agreement Termination, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature are intended to survive termination.

11. Indemnification
You agree to indemnify, defend, and hold harmless Effivac, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any and all third-party losses, damages, liabilities, and claims (including reasonable attorney’s fees).

Such indemnification obligations apply in the following circumstances:
(1) Your violation of these Terms of Service or any platform policy documents incorporated herein by reference;
(2) Your violation of applicable U.S. laws and regulations or the legitimate rights and interests of third parties;
(3) Any violations or infringing acts arising from your access to or use of the platform services.

We will promptly notify you of any indemnifiable claims; however, failure to provide timely notice does not absolve you of your indemnification obligations, unless such failure causes you material prejudice. We reserve the right to control the defense and settlement of such claims and to select defense counsel, with all related costs borne by you; provided, however, that we will not finalize any settlement requiring you to undertake non-monetary obligations without your consent (which consent shall not be unreasonably withheld). 12. Governing Law
The formation, effectiveness, performance, interpretation, and dispute resolution regarding these Terms of Service shall be governed by the laws of the State of Florida, USA, without regard to conflict of law principles.
